Though opposed by many financial companies, the bill cleared Congress with broad support.&lt;br /&gt;&lt;br /&gt;Obama made clear that he didn't champion the changes with the intention of helping those who buy more than they can afford through "reckless spending or wishful thinking."&lt;br /&gt;&lt;br /&gt;"Some get in over their heads by not using their heads," the president said. "I want to be clear: We do not excuse or condone folks who've acted irresponsibly."&lt;br /&gt;&lt;br /&gt;And yet, he said, for many of the millions of Americans who use credit cards and carry a balance, trying to get out of debt has been made difficult and bewildering by their credit card companies.&lt;br /&gt;&lt;br /&gt;Obama said many "got trapped" because of the downturn in the economy that has turned family budgets on their heads. But, he said, "part of it is the practices of the credit card companies."&lt;br /&gt;&lt;br /&gt;He criticized policies that allowed for &lt;strong&gt;confusing fine print&lt;/strong&gt;; the sudden appearance of unexplained fees on bills; unannounced shifts in payment deadlines, interest charges or rate increases even when payments aren't late; and payments directed to balances with the lowest interest rates rather than the highest.&lt;br /&gt;&lt;br /&gt;"We're here to put a change to all that," Obama said.&lt;br /&gt;&lt;br /&gt;One part of the bill Obama did not publicly celebrate at the signing, a gun amendment. The measure by Sen. Tom Coburn, R-Okla., allows people to bring loaded &lt;br /&gt;guns into national parks and wildlife refuges.&lt;br /&gt;&lt;br /&gt;The addition of the amendment to the bill — and Obama's acceptance of it — was viewed as a bitter disappointment for gun-control advocates.&lt;br /&gt;&lt;br /&gt;They watched gun-rights supporters gain a victory from a Democratic-controlled Congress and a Democratic president that they couldn't achieve under a Republican Congress and president. Many blamed the National Rifle Association, which pushed hard for the gun law.&lt;br /&gt;&lt;br /&gt;The new credit card rules, which go into effect in nine months, prohibit companies from giving cards to people under 21 unless they can prove they have the means to pay the debt or a parent or guardian co-signs. A customer also will have to be more than 60 days behind on a payment before seeing a rate increase on an existing balance. Even then, the lender will be required to restore the previous, lower rate if the cardholder pays the minimum balance on time for six months.&lt;br /&gt;&lt;br /&gt;And consumers also will have to receive 45 days' notice and an explanation before their interest rates increase.&lt;br /&gt;&lt;br /&gt;Last year, the Nilson Report estimated that more than 700 million credit cards were in circulation in the United States. That's more than two cards for every man, woman and child.&lt;br /&gt;&lt;br /&gt;The president noted that nearly half of all Americans carry a balance on their credit cards, and that their average balance is more than $7,000. According to the Federal Reserve, the nation is some $2.5 trillion in debt, a figure that does not include home mortgages.&lt;br /&gt;&lt;br /&gt;Obama decried the "uneasy, unstable dependence" that a minority of card users have on credit.&lt;br /&gt;&lt;br /&gt;"So we're not going to give people a free pass, and we expect consumers to live within their means and pay what they owe," Obama said. Interview several real estate professionals (agents), and ask for and check references before you select one to help you buy or sell a home. Don’t be fooled into paying too much. In the past few years over-inflated values has become the number one fraudulent act committed.&lt;br /&gt;&lt;br /&gt;4. Hire a properly qualified and licensed home inspector to carefully inspect the property before you are obligated to buy. Determine whether you or the seller is going to be responsible for paying for the repairs. If you have to pay for the repairs, determine whether or not you can afford to make them. Make sure the home inspector is hired by you and in no way knows the seller or real estate agent. You want an impartial third party to be looking out for your best interests.&lt;br /&gt;&lt;br /&gt;5. Shop for a lender and compare costs. Be suspicious if anyone tries to steer you to just one lender. Mortgage professionals say that some knowledge about the scoring system helps.&lt;br /&gt;&lt;br /&gt;"Sometimes, I'll tell borrowers their score, and they'll start yelling at me," said Debra Killian, president of the Charter Oak Lending Group, a mortgage broker and lender in Danbury, Conn., who teaches courses on the credit-reporting industry. "And I have to explain I'm not the one who's generated the score."&lt;br /&gt;&lt;br /&gt;The reports come from Experian, Equifax and TransUnion, credit bureaus that evaluate the financial-management abilities of millions of Americans.&lt;br /&gt;&lt;br /&gt;Credit-card companies, utilities and other creditors send reports to the bureaus, which rely on software from the Fair Isaac Corp. (creator of the FICO score), along with their own, to grade a borrower on an ascending scale of 300 to 850.&lt;br /&gt;&lt;br /&gt;The software is a black box of sorts, whose workings are known only to the companies involved. Each credit bureau will weigh certain factors differently - the number of late payments, for example, or the number of credit-card accounts open.&lt;br /&gt;&lt;br /&gt;To account for those differences during the mortgage application process, loan officers review the scores from all three credit bureaus and base their loan offers on the middle number. If a couple - married or not - is jointly applying for a mortgage, the loan officer will choose the middle score of the partner with the lower score.&lt;br /&gt;&lt;br /&gt;That score essentially dictates the loan terms that a lender offers. For instance, a borrower with a credit score of 699 will often get a higher interest rate than a borrower with a score of 700. And the higher the interest rate, the bigger the broker's commission from the lender, known in the industry as a yield-spread premium.&lt;br /&gt;&lt;br /&gt;That is why, mortgage executives said, borrowers should be proactive about this part of the mortgage process. Killian of Charter Oak said borrowers should ask the broker or lender to explain how their score changes the terms of the transaction.&lt;br /&gt;&lt;br /&gt;Brokers buy reports from services that supply data from the three credit bureaus, and each report gives details about items that adversely affect a score.&lt;br /&gt;&lt;br /&gt;If a consumer wishes to challenge such items, credit bureaus will do so on the consumer's behalf, or consumers can also call or write creditors directly. WASIK&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;I was the victim of a form of identity theft - twice.&lt;br /&gt;&lt;br /&gt;I'm not particularly proud of this fact. On both occasions, my credit card numbers were stolen. The first time, someone pilfered my account to ring up betting charges in Europe. The second time, the villain went on a shopping spree at an office-supply store.&lt;br /&gt;&lt;br /&gt;Although I didn't have to pay for any of the fraudulent charges, I discovered there's a lot I could have done to prevent this from happening and avoid potential damage to my credit rating.&lt;br /&gt;&lt;br /&gt;Due to the increased use of online shopping, tougher credit standards, and the relative ease of this felony - known as the "gunless robbery" - identity theft will get worse. Some 10 million people a year are victims, according to the Federal Trade Commission, resulting in $50 billion of lost business.&lt;br /&gt;&lt;br /&gt;Todd Davis, chief executive of &lt;a href="http://www.kqzyfj.com/click-2574188-10434176" target="_blank" onmouseover="window.status='http://www.lifelock.com/default.aspx?promocode=CJ';return true;" onmouseout="window.status=' ';return true;"&gt;LifeLock&lt;/a&gt;&lt;br /&gt;&lt;img src="http://www.awltovhc.com/image-2574188-10434176" width="1" height="1" border="0"/&gt; Inc., an identity-theft protection company in Tempe, Ariz., estimates that half of all such robberies are committed by organized crime. The other half are through "social engineering, that is, people like waiters and waitresses, dumpster divers going through trash, your friends and family."&lt;br /&gt;&lt;br /&gt;What's vexing to consumers is the time lost in trying to repair their standing with credit agencies and fixing collateral damage.&lt;br /&gt;&lt;br /&gt;The first time I was ripped off, my phone company mistakenly shut off my Internet and landlines because I was being billed to a credit card account that had to be closed.&lt;br /&gt;&lt;br /&gt;The best way to prevent identity theft is to monitor your credit carefully:&lt;br /&gt;&lt;br /&gt;Look at your credit report at least twice a year and well in advance of a major installment loan or mortgage application. You can do a cursory check of all three agencies at annualcreditreport.com.&lt;br /&gt;&lt;br /&gt;Immediately report any errors and keep a close eye on whether any unauthorized applications for credit were opened recently. That's a red flag that someone may have stolen your data.&lt;br /&gt;&lt;br /&gt;Don't offer your credit card or driver's license numbers to an organization you don't know and never provide your Social Security details unless it's absolutely required by a trusted firm.&lt;br /&gt;&lt;br /&gt;If you want to get an extra layer of protection, enroll in extended fraud protection programs. They will scan your accounts and credit files constantly for unusual billing.&lt;br /&gt;&lt;br /&gt;Want to take it a step further? Shred any documents or mail that may have account or personal information on it. Use "virtual" credit card numbers provided by your bank for online purchases, if available.&lt;br /&gt;&lt;br /&gt;Should you discover that you have been victimized, notify your credit card company immediately and close your account. Also file a report with your local police department.&lt;br /&gt;&lt;br /&gt;The bank will send you an affidavit to notarize for any charges you haven't incurred. Document the fraudulent ones and send it back immediately.&lt;br /&gt;&lt;br /&gt;While filing an affidavit to note scam charges is part of the process, you need to follow up with credit bureaus to ensure these billings are taken out of their scorings. In other words, you need to see that they "rescore" once you have cleared up your accounts.&lt;br /&gt;&lt;br /&gt;The larger problem with identity theft is that it may sabotage your credit standing. Say a thief uses your card number and charges more than your credit limit. That lowers your rating and may make you ineligible for loans.&lt;br /&gt;&lt;br /&gt;Need credit immediately after fixing your record? Ask the credit bureaus to do "rapid" rescoring.&lt;br /&gt;&lt;br /&gt;To lock down your credit information, you can request that a "freeze" be put on your file through the three major bureaus, Equifax, Experian, and TransUnion. This will prevent anyone from accessing your information.&lt;br /&gt;&lt;br /&gt;Keep in mind that if you request a freeze, you will need to unfreeze before you apply for more credit.&lt;br /&gt;&lt;br /&gt;"I wouldn't recommend a freeze unless you have a need for it," says Gerri Detweiler, a credit adviser with credit.com, a consumer website. Unfortunately, there are no quick fixes for credit problems, and, accordingly, Attorney General Dustin McDaniel issued this consumer alert to warn consumers about credit repair schemes. &lt;br /&gt;&lt;br /&gt;"Nobody can legally remove or adjust negative information on your credit report," said McDaniel. "The only thing that can fix a bad, but accurate, credit report is time, and, therefore, consumers should save their money and ignore credit repair offers that claim otherwise."&lt;br /&gt;&lt;br /&gt;The following are warning signs that consumers should heed when dealing with credit repair companies:&lt;br /&gt;• The company asks you to pay up front before any services are rendered; &lt;br /&gt;• The company does not inform you of your legal rights or services you can perform yourself, for free; &lt;br /&gt;• The company advises you to dispute all the information in your credit report; and &lt;br /&gt;• The company advises you not to contact a credit reporting agency directly. &lt;br /&gt;&lt;br /&gt;There are three major credit reporting agencies—Experian, TransUnion and Equifax. Under the law, these consumer credit reporting agencies are allowed to report accurate negative information on your report for seven years and bankruptcy information for 10 years. &lt;br /&gt;&lt;br /&gt;Consumers are entitled to receive a free copy of their credit report once a year. Additionally, you are entitled to a free report if a company takes adverse action against you, like denying your application for credit, insurance, or employment, and you ask for your report within 60 days of receiving notice of the action. The latest comes from a San Diego company, TradeLine Solutions, which claims it can improve a borrower’s credit score by adding somebody else’s top-notch credit history to the borrower’s history. &lt;br /&gt;&lt;br /&gt;But industry trade groups and consumer advocates warn borrowers to be wary of that program as well as others that play off borrowers’ fears that they will lose their homes when mortgage rates reset to significantly higher levels. &lt;br /&gt;&lt;br /&gt;For a $1,399 fee, TradeLine adds the borrower’s name to a stranger’s recently paid-off loan just before the account is closed. The account, with its perfect payment history, is then added to the borrower’s credit record in 30 to 45 days. &lt;br /&gt;&lt;br /&gt;Ted Stearns, chief executive of TradeLine Solutions, said he came up with what the company calls its “seasoned primary accounts” program using a “loophole” in the law. Adding a single account can raise a credit score by 35 to 40 points, he said. But most clients purchase three accounts, at $1,399 for the first one and slight discounts for subsequent ones, to increase a score from say 560 to 700, he said. &lt;br /&gt;&lt;br /&gt;The program’s concept, he said, is similar to someone’s buying a car and taking over somebody else’s car loan or lease account at the time of purchase — except, in this case, there is no balance on the account. The original borrower is unaware that a new name is being attached to the account, he said. Mr. Stearns defended his program. “I am a legal entity that conducts business throughout the state of California and the entire continental U.S.”&lt;br /&gt;&lt;br /&gt;But Craig Watts, consumer affairs manager at the credit analysis firm Fair Isaac Corporation, said the program raised red flags. &lt;br /&gt;&lt;br /&gt;“They’re falsifying the person’s credit history, and that’s one definition of loan fraud,” Mr. Watts said. Even if TradeLine has found a legal loophole to offer the program, the people using the program are knowingly raising their credit scores artificially when applying for a loan or refinancing, he said, adding, “If the borrower is deliberately misrepresenting himself and his credentials to the lender, that’s loan fraud.” &lt;br /&gt;&lt;br /&gt;Mr. Watts said that if law enforcement officials chose to prosecute, borrowers could potentially risk losing far more than just their homes. &lt;br /&gt;&lt;br /&gt;Fair Isaac developed the FICO scores, which are the most widely used scores for assessing credit risk. It recently fine-tuned its formula, Mr. Watts said, to shut down another credit-enhancing scheme. &lt;br /&gt;&lt;br /&gt;He emphasized in an interview that his firm is not a law enforcement agency, but would bring concerns to the attention of the Justice Department, Federal Trade Commission, the F.B.I. and attorney general’s office if lenders started complaining about such practices. &lt;br /&gt;&lt;br /&gt;George Hanzimanolis, president of the National Association of Mortgage Brokers, expressed similar concerns. &lt;br /&gt;&lt;br /&gt;“You’re representing something to be true that is not,” he said. “Artificially increasing the scores to make them look like they’re creditworthy is a road to disaster.” &lt;br /&gt;&lt;br /&gt;Mr. Hanzimanolis said companies that seemingly offer help to individual borrowers might actually be making matters worse. He said he was concerned that many of these loans might wind up becoming delinquent later because they involve people with poor credit. When this happens, he said, the whole industry could suffer. &lt;br /&gt;&lt;br /&gt;“There’s no way anybody would be able to determine what customers’ true credit profiles looked like,” he said. “Then we’ll have more homes going into foreclosure, which will end up driving home prices down across the country and affecting banks, consumers — everybody.”&lt;br /&gt;&lt;br /&gt;The F.T.C. and other federal agencies declined to comment on the programs or to say whether any investigations were under way. &lt;br /&gt;&lt;br /&gt;“Investigations are nonpublic and we don’t opine over whether something is legal or not,” said Frank Dorman, public affairs specialist with the F.T.C. &lt;br /&gt;&lt;br /&gt;Fair Isaac has already taken steps to crack down on another credit repair program that TradeLine and a number of other companies, including Instant CreditBuilders.com and SeasonedTradeLines.com, began offering in the last year. &lt;br /&gt;&lt;br /&gt;Under this program, subprime borrowers are added as “authorized users” onto credit cards belonging to strangers with strong credit scores and reliable payment histories. Each credit card could add about 35 points to a credit score. SeasonedTradeLines.com’s Web site says: “There is one secret the credit scoring granddaddy and the credit bureaus do not want you to know: Good credit scores can be bought!” &lt;br /&gt;&lt;br /&gt;Last spring, lenders began complaining to Fair Isaac that this program, known as credit piggy-backing, would undercut the credibility of credit scores, Mr. Watts said. As a result, Fair Isaac, after consulting with lenders and federal regulatory officials, decided to change its scoring formula to ignore “authorized users” when tallying a person’s FICO score. The formula change is expected to take effect at two of the credit bureaus — Experian and Trans Union — by this spring, Mr. Watts said. &lt;br /&gt;&lt;br /&gt;“Authorized user accounts will still show up on credit reports obviously, but the FICO score will no longer see them,” he said. &lt;br /&gt;&lt;br /&gt;Mr. Hanzimanolis said he was not surprised that companies were offering schemes to tap into homeowners’ fears and desperation in light of the subprime credit crisis. &lt;br /&gt;&lt;br /&gt;“If this kind of practice isn’t stopped, I think it’s going to be a disaster,” he said.&lt;br /&gt;&lt;br /&gt;Economists are predicting another wave of rate resets in the next year, involving homeowners who took out subprime mortgages, adjustable-rate mortgages and hybrids from 2003 to 2005. It was a slippery slope.&lt;br /&gt;&lt;br /&gt;Soon, he was paying only the minimum payments on his card balances.&lt;br /&gt;&lt;br /&gt;Not long after, unexpected emergencies like a flooded living room caused Rogers to begin making late payments and eventually missing payments altogether.&lt;br /&gt;&lt;br /&gt;Two years later, after fees and increased interest rates due to late or missed payments, he found himself nearly $30,000 in debt spread across three credit cards and saddled with poor credit scores.&lt;br /&gt;&lt;br /&gt;In 2004, the average credit card balance for Americans was $5,100, according to a Federal Reserve Board report.&lt;br /&gt;&lt;br /&gt;"You're just going into a hole, and continuing to go into hole, and then that affects everything else," said Rogers, "You can't do any financial planning because you're always behind."&lt;br /&gt;&lt;br /&gt;"You keep getting deeper and deeper into debt."&lt;br /&gt;&lt;br /&gt;An IT area manager at AT&amp;T, Rogers said he made "good money" but still couldn't get a handle on his growing debt.&lt;br /&gt;&lt;br /&gt;In 2003, alarmed by his rising debt and decreasing credit score, Rogers stopped using his credit cards. The move stopped the creation of more debt, but he wasn't making any progress on paying down his existing balances.&lt;br /&gt;&lt;br /&gt;He decided to seek help and joined a debt elimination program with the Consumer Credit Counseling Service. The program helped Rogers negotiate better interest rates on his cards, knocking down some by as many as seven interest points.&lt;br /&gt;&lt;br /&gt;Rogers paid down all of his credit card debt after four years of budgeting and abstaining from credit card use. However, he now faces the daunting task of improving his credit score.&lt;br /&gt;&lt;br /&gt;Being proactive&lt;br /&gt;Credit scores can range from a 300 to a perfect 850. Typically, consumers with scores above 700 are charged relatively low interest rates, while those with scores below 600 are often faced with high loan rates or are unable to borrow at all.&lt;br /&gt;&lt;br /&gt;The information that makes up a credit report is collected by three U.S. reporting companies -- TransUnion, Equifax and Experian -- and scores can vary across the different agencies.&lt;br /&gt;&lt;br /&gt;Credit information, both good and bad, stays on a credit report for an average of seven years, according to the Federal Reserve Board.&lt;br /&gt;&lt;br /&gt;Credit counselors recommend taking a proactive approach and regularly checking your credit report, especially in an era of increasing identity theft.&lt;br /&gt;&lt;br /&gt;Rogers said he didn't know his credit score had plummeted because he never bothered to check.&lt;br /&gt;&lt;br /&gt;"Most of us don't actually have an encounter with our credit score until we're trying to get something, a house or something like that," Rogers said. "Then you find out, 'Aw man, I didn't realize I was in that bad of shape.'"&lt;br /&gt;&lt;br /&gt;Now, he considers looking over a monthly copy of his credit report a key part of his plan to repair his credit reputation.&lt;br /&gt;&lt;br /&gt;Every consumer is entitled to one free credit report a year under the Fair and Accurate Credit Transactions Act.&lt;br /&gt;&lt;br /&gt;'Take it slow'&lt;br /&gt;Gail Cunningham, vice-president of the Consumer Credit Counseling Service of Greater Dallas, advised anyone trying to repair their credit to start slow. "The most important thing is to get that debt paid for and then the credit will rebuild itself," she said.&lt;br /&gt;&lt;br /&gt;Good credit management means being able to pay bills on time each month and paying off the entire balance in a reasonable amount of time, said Cunningham. Making even one late payment can cause a credit score to drop as much as 100 points.&lt;br /&gt;&lt;br /&gt;After paying down card balances, consumers are often flooded with new offers for credit cards. Cunningham cautions people to be wary of the new offers, to take the time to search for the card with the best interest rate and build from there.&lt;br /&gt;&lt;br /&gt;She advises the best thing to do after paying off your debt in full is to open one general credit card account and pay the balance off in full every month.&lt;br /&gt;&lt;br /&gt;"When it comes to rebuilding credit, time is your friend, because it's not going to happen overnight," Cunningham said. "But a series of small, smart steps will pay off."&lt;br /&gt;&lt;br /&gt;Now free of all credit card debt, Rogers said he plans to take full advantage of his clean slate as he moves to rebuild his credit. His plan is to charge only when absolutely necessary and to pay his credit card debts off in full each month.&lt;br /&gt;&lt;br /&gt;If managed responsibly, Rogers could see an increase in his credit score in as soon as six months, Cunningham said.&lt;br /&gt;&lt;br /&gt;In hindsight, it seems simple.&lt;br /&gt;&lt;br /&gt;"It's pretty straightforward stuff, you get credit, you pay off your bills on time, or before time, and you reestablish it," said Rogers.
